Affidavit Notice


** NEW LAW - Effective November 1, 2023 **

All deeds filled in in the County Clerk's Office shall have an Affidavit for Ownership or Title to Land attached as an exhibit to the deed for each grantee on the deed. This affidavit will be filed as part of the record.

The affidavit stands as a testament that the entity or person complies with the state laws on foreign ownership. It confirms the individual/entity is over 18 years of age, either a U.S. Citizen or potential bona fide resident of Oklahoma acknowledges the law on Foreign property ownership, and the prohibition on using certain funding sources.

The affidavits may be found under the Public Forms section on the Attorney General's website at www.oag.ok.gov. You must use the affidavit provided and subscribed to under the law.

Payne County will only be accepting the forms provided by the Attorney General's office per state statute. We also will be rejecting any deed that does not have the affidavit attached as the law reads, we are to do so.
